Wake Up and Be Successful

I love mornings. Almost everyone in my life tries to do everything they can to avoid waking early the morning. For me, if the sun is up, I am up. I LOVE it!

One of the only other weekly events that gets as bad of a rap as mornings are Mondays. I will never underst and why poor Monday always has to be picked on and bullied – especially when Monday isn’t anywhere the start of the work week for everyone anymore. In an effort to help show Mornings and Monday some love, I wanted to share the highlights of an article I came across called, 5 Ways Successful People Tackle Monday Morning by William V anderbloemen (see link below for complete article).
While measuring success can be subjective, we all want to be successful in some shape or form. We want a successful insurance business, while perhaps you want to be successful at making pizza. It doesn’t matter – we all want it.

Here are some ways to kick start your day right into success mode:

Sleep, but do not snooze – there is no possible way to catch-up on lost sleep so it is important to get the best sleep you can when possible. Sunday night might be your most important night to sleep, so stop running yourself down to fumes and gets some rest. However, when Monday morning rolls around, DO NOT HIT SNOOZE! It tells your body that the wake-up was a joke and those few extra minutes cause more harm than good. Get up the first time and you will be more productive.

Get your body moving – yes, this means getting physical and exercise. This will help motivate you, improve performance, and keep you from falling into a slump – thus more productive and successful!

Don’t start work until you get to work – meaning stay away from work email! At the beginning of the week, you set your mental state and if you maintain focus on projects and devote brain power where it is needed, you will avoid the distractive power of email overload.

Avoid big decisions – don’t suddenly quit a job, project, workout, etc.…or make a huge decision on a Monday. That is not a healthy way to start the week. Wait for Tuesday.

Only schedule tangible result work – Monday should be a day of serious results to start the day and the week off on a successful and productive path. Making a list of attainable goals and project and checking them all off will help motivate your workflow the remainder of the week.

Why do you not have life insurance?

Health insurance in now required. That is your body you are protecting and making sure it is covered in case a medical emergency arises. You wouldn’t know what to do if there was a major medical expense due to your health and you didn’t have coverage. Therefore, you get health insurance to stay protected. Why? It is the right thing – the responsible thing to do.
Car insurance – required. In almost every state, it is required by law. This covers the physical property of your vehicle, as well as drivers and passengers. A car is a tangible item that gets you from point A to point B. For many of us, it is something that we cannot live without. Most of us need a car to ‘survive.’ What do you do? You insure it. Why? It is the right thing – the responsible thing to do.
So…you are going to protect yourself and have coverage for everything from a cold to major surgery? You are going to make sure your car has protection so you never have to go without personal transportation? Additionally, you choose to cover your house, your dog, your valuables, and more!

So I ask again…
Why do you not have life insurance?

Is Your Company Hosting A Holiday Party?

While gatherings can provide opportunities for professionals to mingle casually with their co-workers and clients and can help boost employee morale, they can also prove to be a liability for businesses that serve alcohol. That is why businesses should take reasonable precautions to prevent any risks and financially protect themselves by making sure they have the proper insurance, warned the Insurance Information Institute (I.I.I.).

Forty-four states plus the District of Columbia have enacted liquor liability laws. These laws make it possible for a plaintiff to hold those who serve alcohol to an intoxicated or underage person responsible for any damage or injury caused by these same individuals after they leave the party. Most of these laws also offer an injured person, such as the victim of a drunk driver, a method to sue the person who served the alcohol. There are circumstances under these same state laws where criminal charges may also apply.

Liquor liability laws were intended originally to apply to taverns, bars, and other establishments selling and serving alcohol. However, the liability laws have exp anded over time to include “social hosts” (such as those holding a holiday party in their home or business) in some states giving them some exposure to the risk of liability for serving alcohol.

“In many states you can be held legally responsible for your employees’ actions after they leave the party,” said Loretta Worters, vice president of the I.I.I. “If you are throwing an office party where alcohol is served, you have a responsibility to make sure that your employees are capable of driving safely.”

Worters noted that when business owners host a holiday party and serve alcohol as part of the festivities, liquor liability would most likely be covered by their commercial general liability (CGL) policy. “It’s best to check with your insurance agent or broker first,” she said, adding, that “if an employee becomes intoxicated and assaults another employee at the party, the incident might be excluded under the CGL policy.”

In addition to a CGL policy, businesses should also consider purchasing an Employment Practices Liability Insurance (EPLI) policy. An EPLI policy will protect a business from discrimination, sexual harassment, emotional distress, and other workplace-related issues. When you buy the coverage, make sure it includes “third-party” coverage. Third-party coverage refers to claims made by non-employees, usually clients or customers, who allege that an employee engaged in wrongful conduct such as sexual harassment or discrimination. This can be important coverage, for example, if someone in management has had too much to drink and makes an inappropriate overture to a client or customer. Without a specific policy endorsement for third-party claims, EPLI policy forms do not cover these types of exposures.

“Even innocent flirting or touching can be misconstrued and result in a lawsuit,” explained Worters.

In addition to overtly inappropriate behavior, if someone puts a video clip or picture on YouTube or Facebook that could result in reputational harm, it is also covered under an EPL policy.

Over the years, office parties have changed considerably. Alcohol used to flow freely, and employers would sometimes overlook inappropriate conduct, explaining away bad party behavior without taking any action. Today, lawsuits are so rampant that some companies have concluded office parties involving alcohol are not worth the risk.

If you plan to host a holiday party at which you will be serving alcohol, the I.I.I. offers the following tips to prevent a lawsuit:

  1. Advise employees to be responsible. Include a statement on the party invitation and/or circulate a written reminder to all concerned on the responsibilities to drink only in moderation and to avoid driving after drinking.
  2. Emphasize to management that they must lead by example.
  3. Hold the party at an offsite location. If problems do arise, it is better that they occur away from the business premises. Depending on the state, the liability will generally be on the restaurant than the company. However, it is not unusual for an employer to be named as a defendant in a civil lawsuit if an intoxicated employee leaves any company-sponsored event and injures himself or herself or another person as a result.
  4. Do not pay for alcoholic drinks. Guest will drink less if they have to pay for the drinks themselves.
  5. If you feel you must furnish alcoholic beverages, consider a drink voucher system to limit the number of drinks served. Or, serve alcohol for only a short period.
  6. Consider hiring a professional bartender. Most bartenders are trained to recognize signs of intoxication and will limit consumption by partygoers.
  7. Offer non-alcoholic beverages and always serve food. It is proven that food can help counter the effects of alcohol.
  8. Do not serve alcohol to minors.
  9. Stop serving liquor toward the end of the evening and switch to coffee, tea and soft drinks.
  10. Arrange alternative transportation. Anticipate the need for alternative transportation for all employees and guests and make special transportation arrangements in advance of the party. Encourage all employees and guests to make use of the alternative transportation if they consume any alcohol.

Worters advised business owners to talk with their insurance agent or company representative about their liability insurance coverage and any exclusions, conditions or limitations to their policies for this kind of risk. “Appropriate liability insurance coverage is necessary. In some cases special event coverage may be available that will cover both liquor liability and other liability exposures specific to the event.”

California Earthquake Authority rates go down

An article written by the Insurance Journal, California Insurance Commissioner Dave Jones has just approved a rate reduction of up to 10% for earthquake insurance policies issued by the CEA.  This rate reduction should be reflected in policies that renew after January 1, 2016.  In addition, new deductible options will become available ranging from 5% up to 25% and coverage enhancements on personal property and loss of use or additional living expenses.

As an FYI, the California Earthquake Authority or CEA for short has around 865,000 policyholders in California.  They estimate that they issue around 75% of all residential earthquake policies purchased in California.

What To Do If Your Car Breaks Down On The Highway

Transportation_FlatTireYou are driving down the highway when suddenly you have car trouble. The National Safety Council suggests the following measures when your car breaks down or has a flat tire on the highway.

At the first sign of car trouble, gently and smoothly take your foot off the accelerator. Do not brake hard or suddenly. Carefully work your vehicle toward the breakdown lane or the side of the road. If you are on an interstate, try to reach an exit. Signal your intentions to drivers behind you. If it is necessary to change lanes, watch your mirrors and the traffic around you closely.

Once off the road, make your car visible. Put reflectorized triangles behind your vehicle to alert other drivers; use your emergency flashers. If it is dark, turn on the interior dome light.

When you have a flat tire, be certain that you can change it safely without being close to traffic. If that is possible, change the tire as you normally would. Remember, safety must take precedence over your schedule or whatever other concerns you may have.

However, when the car is beyond repair, it is best to get professional help. Do not try to flag down other vehicles. Raise your hood and tie something white to the radio antenna or hang it out a window so police officers or tow truck operators will know help is needed. Don’t st and behind or next to your vehicle. If the car is in the roadway, st and away from the vehicle and wait for help to arrive.

If your car is safely out of traffic, wait inside the vehicle with the doors locked. Use your cellular phone to call for help. If someone stops and offers to help, open the window slightly and ask them to call the police.

Watch for a uniformed police officer or other emergency personnel. All interstate highways and major roads are patrolled regularly. Also, some highways have special “call-for-help” phones.

It is inadvisable to walk on an interstate, especially during inclement weather. However, if you can reach a source of help on foot, without jeopardizing your physical or personal safety, try the direct approach by walking. Keep as far from traffic as possible and walk on the right side of the roadway. Never attempt to cross a multi-lane, high speed
roadway.

Don’t Take Life For Granted

Life is a gift. It is a precious gift we all take for granted. This isn’t a knock on anyone in particular, it just is something we don’t really think about, the same as breathing or waking up in the morning. We don’t really think about these things, but in all honesty, it is something we should. To be alive. To live and to love. To see the great wonders of the world and to experience life is truly the best gift of all. While we all feel pain, sadness and guilt at different parts of our life, it does not undo that we are alive and can feel the world around us. It is sad that not all of us are able to open up to the world, but after I learned of my HIV, it made me look at life and realize that, up to that point in time, I had taken it all for granted, and after I moved past the sudden shock and depression of the diagnosis, I decided to never take life for granted ever again.

Of course, I did take out some protective measures, such as life insurance, to ensure my family can continue living their lives in peace and comfort. After all, while I might have to live with HIV, there is no reason they should feel the side effects after I am gone.
